Volgens de rechter kun je met de modchip inderdaad backups spelen, zoals dat als wettelijk recht is vastgelegd. Maar door een modchip wordt het uitwi elen van games onder eigenaren van games oncontroleerbaar, aangezien de games 45 pond per stuk kosten. De belangrijkste functie van de mod komt dus te liggen bij het illegaal uitwi elen van games en om deze reden alleen al is Sony in het gelijk gesteld.
Intere ant is dat de rechter ook is ingegaan op het regiosysteem van Sony. In de license voorwaarden is duidelijk te lezen dat Sony het spelen van een spel buiten de regio waarin het gekocht is verbiedt. De rechter ondersteunt deze voorwaarden door te stellen dat een buiten de regio gekocht spel wordt gekopieerd in het geheugen wanneer je het spel opstart, hiermee een illegaal kopie maakend. Hiermee is het importeren van spellen of het meenemen van spellen van je vakantieland ook gelijk illegaal geworden. Een belangrijke uitspraak die ook gevolgen kan gaan hebben voor DVD liefhebbers.
Hier een stukje van de reactie van Gazza (van Channel Technology) op de uitspraak.This was an untested area of law in the UK, and Channel Technology resisted summary judgment on the basis of the legal functions that could be gained from such a device as the Me iah. The decision gained in Sony's favor is undeniably correct, Channel Technology does not deny that the device could be used for the use of illegal games, and did not contest this matter at any time, it simply made argument on technical matters in respect-of, and the arguably legal functions that are restricted from the implementation of such copy-protection methods.
The fact that Sony sells CD-Recording devices is obviously a similar argument, for any company to deny knowledge that it's equipment could be used for illegal purposes would be farcical, and indeed, CD-Recorders are the root of CD based piracy. However, companies selling such devices are not under the scrutiny of the CDPA 1988 in respect of circumvention (unle po ibly selling software or hardware capable of by-pa ing protection systems implemented on original media) and therefore are afforded the right to do so.
When the industry collapses within itself from it's own 'backstabbing' of producing recorders and recordable media, as well as entertainment media that people would wish to record for multitudes of reasons, then po ibly the corporations will wake up to the reality of the world, and the way the world functions. The number of free spirits in society will far outnumber the amount of courtroom casualties these corporations will have to their accounts.
